Man from Busia Takes Legal Action Against Governor Otuoma, Seeks Ksh100M

Busia Governor Paul Otuoma is facing a court case after a man accused him of assault and intimidation, demanding Ksh100 million in compensation.
The case was filed at the Milimani High Court, where the petitioner claims the incident happened on March 6, 2026, during a county function at Bukri Market in Funyula Constituency.
According to court records, the complainant, Yusuf Suleiman Hamisi, a 31-year-old boda boda rider, said he was attacked while waiting in line to receive certified maize seeds being distributed at the event.
The petition states that the governor allegedly kicked him without any provocation. The incident is said to have been witnessed by several people and recorded on video, which later spread widely on social media.
Through his lawyer, Danstan Omari, Hamisi also claims that he faced challenges when trying to get treatment at Sioport and Ruambo Sub-County hospitals. He alleges that the interference was connected to the governor’s office.
The matter was later reported at Sioport Police Station. However, the petitioner claims that shortly after reporting, he started receiving threats.
Court documents further state that unknown individuals visited his home and pressured him to drop the case. He also alleges that he was briefly abducted but managed to escape, forcing him to go into hiding for his safety.
The petitioner argues that the governor’s alleged actions violated his constitutional rights, including his right to dignity, personal security, equality, and fair treatment. He also claims it goes against leadership and integrity laws outlined in Chapter Six of the Constitution and the Leadership and Integrity Act.
In the case, the petitioner is asking the court to declare the governor unfit to hold public office. He also wants authorities to investigate the matter and for the Busia County Assembly to begin impeachment proceedings under Article 181.
Additionally, the petition seeks protection and proper medical care for the victim, as well as a full investigation into the incident.
