EFF Party Leader, Julius Sello Malema Has Been Sentenced to 5 Years in Prison

Economic Freedom Fighters (EFF) leader Julius Sello Malema has been sentenced to five years in prison after being found guilty of firearm-related offences.

The ruling was made by the East London Regional Court, where the court said Malema unlawfully possessed and discharged a firearm during an EFF event.

According to the judgment delivered by Magistrate Twanet Olivier, the court carefully considered all the arguments presented by the defence before reaching its final decision.

The magistrate said the sentence was meant to reflect both the seriousness of the offence and fairness in the justice system.

Although the court acknowledged that Malema is a first-time offender, it maintained that the offence was serious because it put public safety at risk.

Court Rejects “Celebratory Shot” Defence

During the case, Malema’s defence team argued that the firearm was discharged as a celebratory shot during the EFF anniversary celebrations.

However, the court rejected this explanation.

Magistrate Olivier described the argument as unacceptable and stated that the incident could not be treated as harmless.

The court found that Malema was fully aware that his actions were against the law.

According to the ruling, the act was not accidental but was instead a planned move carried out during the public event.

Full Sentencing Details

The court issued the following sentences:

  • Count 1: 5 years imprisonment
  • Count 2: 2 years imprisonment
  • Count 3: Fine of R20,000 or 6 months imprisonment
  • Count 4: Fine of R20,000 or 6 months imprisonment
  • Count 5: Fine of R20,000 or 6 months imprisonment

The court ordered that the sentences run concurrently, meaning Malema will serve the prison terms at the same time.

The magistrate further noted that even though the incident happened in a short period, it still posed a danger to people around the event.

The court also stated that the action appeared to have been approved beforehand, which showed a lack of concern for public safety.

This, the court said, was one of the key reasons behind the prison sentence.
