The Milimani Law Courts in Nairobi have upheld the impeachment of former Deputy President Rigathi Gachagua, marking a major turning point in Kenya’s political scene and effectively blocking him from running for president in the 2027 general election.

A three-judge bench made up of Justices Eric Ogolla, Anthony Mrima, and Freda Mugambi delivered the ruling after hearing consolidated petitions challenging how Gachagua was removed from office.

The court was asked to determine whether his impeachment followed the law and whether the Senate process that removed him was valid under the Constitution.

Major impact on Gachagua’s political future

The ruling means Gachagua now faces serious political consequences. Under Kenya’s Constitution, a leader who is lawfully impeached is disqualified from holding public office, including running for president or serving in any state position.

This decision effectively locks him out of the 2027 presidential race unless a higher court overturns the ruling on appeal.

Appeal still possible

Gachagua’s legal team is expected to challenge the decision at the Court of Appeal and possibly the Supreme Court. However, unless the ruling is overturned, the ban on holding public office remains in force.

Legal experts note that similar rulings have been upheld before, including cases where impeached leaders were permanently barred from returning to politics.

Loss of benefits and pension dispute

Beyond politics, the ruling also affects Gachagua’s financial benefits. If the impeachment stands, he will lose entitlement to retirement perks such as a pension, state security, medical cover, and a fully funded office.

His legal team is now focusing on compensation claims, arguing that the impeachment process may have violated constitutional procedures.

Political realignment ahead of 2027

Even with the court ruling, Gachagua’s allies have already begun reorganizing politically. A new party, the Democracy for Citizens Party (DCP), has been formed, which could play a key role in shaping opposition politics ahead of the 2027 elections.

Analysts say his influence in the Mt Kenya region could still affect President William Ruto’s political support base, depending on how the situation develops.
